Vision of the Entertainment Duty Branch
- As per Mumbai (Maharashtra) Entertainment Duty Act, 1923 responsibility of controlling and supervising the working of the Districts.
- To expedite Pending collection of Entertainment Duty charges in the Division.
- To implement the Standing Orders issued by the Government from time to time.
- To follow up for the pending recovery of audit paras and acceptance of pending paras from the Accountant General.
- To hear and decide appeals under Section 10A of the Mumbai (Maharashtra) Entertainment Duty Act, 1923.
- To Enter into the all types of Entertainment centres as per Section 8 of the Mumbai (Maharashtra) Entertainment Duty Act, 1923.
However, Government of Maharashtra, Extraordinary Gazette Part IV dt. 29th May, 2017, Maharashtra Goods and Services Tax Laws Act 2017, Chapter III, Amendment of Maharashtra Entertainment Duty Act, the words “District Magistrate” and “Commissioner” in the Entertainment Duty Act have been replaced by “Local Authorities” (Municipal Corporation, Municipal Councils, Zilla Parishads, Cantonment Boards).
Also, Government of Maharashtra, Extraordinary Gazette Part IV-B, dated July 1st, 2017, With the introduction of Goods and Services Tax on Entertainment, the Government of Maharashtra has exempted Entertainment Duty levied under Section 3 of the Maharashtra Entertainment Duty Act, 1923 till further orders or September 15, 2017 whichever is earlier. Thereafter Government of Maharashtra, Gazette Part IV-B, dt. 22nd November, 2023 Revenue and Forest Department Order No. ENT-2017/P.No.111/T-1, dated 1st July, 2017 from payment of Entertainment Duty levied under Section 3 of the Maharashtra Entertainment Duty Act, 1923 Exemption given till dt. 15th September, 2017 is Continued till September 30, 2026.<
Therefore, at present Entertainment Duty branch is dealing with work related to pending entertainment duty collection, pending court matters, quasi-judicial matters, compliance of pending paras of the Accountant General’s Office and pending paras from the internal audit team in the five districts of Nashik Division.
Objective & Function of the Entertainment Duty Branch
As per the Mumbai (Maharashtra) Entertainment Duty Act, 1923 Entertainment duty has been imposed on Multi-screen, Single-screen, moving theatres, V.D.O. Halls, Amusement Parks, Water Sports, Pool Game Parlors, Bowling Alleys, Dance Bars, Discotheques, V.D.O. Games, Cable TV Connections, DTH Connections etc. The recovery of pending Entertainment Duty till 30th June, 2017 from these Entertainment Centre’s is underway.
In the Divisional Commissioner Office Entertainment Duty Branch is headed by a Joint Commissioner (Entertainment Duty), assisted by Two Entertainment Duty Inspectors, One Revenue Assistant, One Peon & One Driver. There are total Six sanctioned posts for Entertainment Branch.
